By accessing or using PixelTools ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

2. Description of Service

PixelTools provides AI-powered image processing tools, including:

• Background removal
• Watermark removal
• Image upscaling
• Additional image editing tools (as added)

3. Account Registration

3.1 Account Creation

• You must be at least 13 years old to use this Service
• You must provide accurate and complete information
• You are responsible for maintaining account security
• You are responsible for all activities under your account

3.2 Account Security

• Keep your login credentials secure
• Notify us immediately of any unauthorized access
• We are not liable for losses due to unauthorized use of your account

4. Acceptable Use

4.1 You agree NOT to:

• Upload illegal, harmful, or offensive content
• Upload images you don't have rights to
• Use the Service to violate any laws or regulations
• Attempt to circumvent usage limits or restrictions
• Reverse engineer, decompile, or hack the Service
• Use automated tools (bots, scripts) without permission
• Resell or redistribute our Service without authorization
• Upload malicious files (viruses, malware)
• Remove copyright, watermarks, or credits from our Service
• Use the Service to create, distribute, or process child exploitation material
• Use the Service to create deepfakes or misleading content for malicious purposes

4.2 Content Guidelines

You may only upload images that:

• You own or have permission to use
• Do not violate any copyright or intellectual property rights
• Do not contain illegal content
• Are not pornographic or sexually explicit
• Do not depict violence, gore, or harm to others
• Do not contain hate speech or discriminatory content

5. Usage Limits

5.1 Free Tier

• 3 images per day
• 90 images per month maximum
• Rate limits apply per IP address and account
• Advertisements may be displayed

5.2 Paid Plans

• Starter: 100 images per month
• Pro: 500 images per month
• Business: 2,000 images per month
• Usage resets on your billing date
• Unused credits do not roll over

5.3 Fair Use

We reserve the right to throttle or suspend accounts that:

• Abuse the Service through excessive automated requests
• Attempt to circumvent usage limits
• Negatively impact Service performance for other users

6. Payment Terms

6.1 Pricing

• Prices are listed in USD
• Prices may change with 30 days notice
• Existing subscribers keep their rate until renewal

6.2 Billing

• Subscriptions are billed monthly or annually
• Payments are processed through Stripe
• You authorize recurring charges to your payment method
• Failed payments may result in service suspension

6.3 Refunds

• Refunds are provided on a case-by-case basis
• No refunds for partial month usage
• Contact support@pixeltools.app for refund requests
• Abuse of refund requests may result in account termination

6.4 Cancellation

• You may cancel your subscription at any time
• Access continues until the end of your billing period
• No partial refunds for early cancellation
• Unused credits are forfeited upon cancellation

7. Intellectual Property

7.1 Your Content

• You retain all rights to images you upload
• You grant us a temporary license to process your images
• We do not claim ownership of your content
• We may use anonymized data for service improvement

7.2 Our Content

• The Service, including design, code, and branding, is owned by PixelTools
• You may not copy, modify, or redistribute our Service
• Our trademarks and logos may not be used without permission

7.3 Processed Images

• You own the processed images we generate
• You may use processed images for any legal purpose
• You are responsible for how you use processed images

8. Data and Privacy

• Your data is handled according to our Privacy Policy
• Uploaded images are automatically deleted within 1 hour
• We do not sell your personal information
• We use cookies as described in our Cookie Policy

9. Service Availability

9.1 No Guarantee of Uptime

• We strive for 99.9% uptime but do not guarantee it
• Scheduled maintenance may cause temporary downtime
• We are not liable for service interruptions

9.2 Service Changes

• We may modify or discontinue features at any time
• We will provide notice of major changes when possible
• Continued use after changes constitutes acceptance

10. Disclaimers and Limitations

10.1 Service "As Is"

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Warranties of merchantability
• Fitness for a particular purpose
• Non-infringement
• Accuracy or quality of results

10.2 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PIXELTOOLS SHALL NOT BE LIABLE FOR:

• Indirect, incidental, or consequential damages
• Loss of profits, data, or business opportunities
• Service interruptions or errors
• Third-party actions or content

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID IN THE LAST 12 MONTHS.

10.3 AI-Generated Results

• AI processing may not always produce perfect results
• Results depend on input image quality
• We do not guarantee specific outcomes
• You are responsible for verifying results before use

11. Termination

11.1 By You

• You may delete your account at any time
• Email support@pixeltools.app for account deletion
• Data will be deleted according to our retention policy

11.2 By Us

We may suspend or terminate your account if you:

• Violate these Terms
• Abuse the Service
• Fail to pay for subscriptions
• Engage in fraudulent activity
• Upload illegal or harmful content

12. Indemnification

You agree to indemnify and hold harmless PixelTools from any claims, damages, or expenses arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any rights of another party
• Content you upload or process

13. Dispute Resolution
